Does PIPEDA require opt-in consent like GDPR?
Not always. PIPEDA allows implied (opt-out) consent for routine, non-sensitive uses. That’s a notable difference from GDPR. Express opt-in is required for sensitive data, uses outside a customer’s reasonable expectations, or anything carrying real risk of harm.
Can I still run retargeting and behavioral ads under PIPEDA?
Yes. The Privacy Commissioner allows online behavioral advertising on an opt-out basis, as long as customers know it’s happening, can opt out, the opt-out takes effect immediately, and you’re only using non-sensitive data. Your retargeting doesn’t have to stop. It just needs a clear, working opt-out.
